Terms And conditions
In consideration of the mutual promises and covenant surrounding this engagement, the parties agree to terms and conditions as follows:
a) That as of the contract date, the client had engaged Livemas Real Estate and Constructions (LREC) to SELL this property with assurance of it being litigation free.
b) on this date the client agreed to the said price for execution of this contract
c) That LREC takes from client (seller) a specified commission on price agreed with LREC buyer i.e. 5% where a house is on sale, 5% where a land is on sale or land is on rent.
d. AGENT’S RESPONSIBILITY
The Agent’s role under this contract entails but limited to;
– Searching for buyer, Biding and help Negotiate: we (LREC) are charged to search, bid and help negotiate the property in benchmark to client price.
– Expenses. LREC bears costs pertaining to discharging hersaid duties.
– Act in Good faith: the agent receives relevant documents surrounding the property (if available) by trust. LREC is obliged to act in good faith not taking chance of the documents in possession.
e. CLIENT RESPONSIBILITY
– Trust and conformance to promises: it behooves on client to have full trust and confidence in our processes and procedures towards disposition of the property without interruptions, be it circumvention or direct exchange of contact with a buyer (i.e. where the client is introduced to buyer until payment) without consent of LREC. It is likewise incumbent on client to conform to the promises made to constitute this selling agreement.
– Documentation; Issual of relevant documents like receipt, site plan, allocation paper, indenture, cadastral plan, lease (if any) etc when a payment is made is a sole duty of the client.
– Agency Registration fee: client pays a non-refundable registration of 100ghc-150ghc to effect this contract. This may help us visit the property to pick pictures, video and site the location where the need be. This charge is for properties in Kumasi and 200ghc for those in Accra and others excluding Kumasi in extreme case of discount.
– Commission to agent: client pays a specified commission (refer to clause c) to LREC after we have sold the property. This must be paid immediately a buyer of LREC makes part payment or full payment or a commitment on the property.
f. NOTICES
Any notice demand or other communication required to be served under this Contract shall be in writing in English language and may be served as follows:
– personally;
– by registered letter or recorded delivery mail including phone call;
– or any other means of recorded delivery;
g. NO VARIATION UNLESS AGREED IN WRITING
Except as expressly provided for in this Contract no variation or amendment of this Contract or oral promise or commitment related to it shall be valid unless same has been reduced into writing and signed by or on behalf of both parties.
h. DISCLAIMER
We are liable by no means if it comes to our notice later that aterm under which the contract was signed is proven false. We reserve the right to take relevant action thereof. Moreover, LREC might need 2-3 months to get the property exposed however we do not guarantee when the property leaves the market. We ask for your patience as we work tirelessly to sell
I .DECLARATION
By submitting the form I hereby this document declares that I am the legitimate owner of the property on discussion and I agree to a hundred percent refund of LREC buyer’s spending (property cost + agent commission) should this declaration be found false.
